Terms of Service

1. What AviSeek is

AviSeek is a tool that helps you find aviation employers and send job applications to them. You give us your professional details, your resume and permission to send email from your own email account. We identify employers that match what you are looking for and send your application to them.

You are the sender. AviSeek is the tool. Every message goes out from your email account, over your own email provider, under your name and your address. AviSeek does not send email on its own behalf and is not the originator of any message you send through it. You are responsible for the content you supply, including your resume and the description you write about yourself, and for the fact that messages are sent in your name.

2. Who can use it

You must be at least 18 and able to enter a contract. You must use an email account you own or are authorized to use. You may not use AviSeek to send anything other than genuine job applications about yourself.

3. Your email account

To send on your behalf we need an application-specific password for your email account. By providing it you authorize us to connect to your email provider and send messages as you, for the purpose of sending job applications and their follow-ups.

We connect for sending only. We do not read, download, index or store the contents of your mailbox. How we store and protect the credential is described in our Privacy Policy. You may disconnect at any time from your account settings, which deletes the credential and stops sending.

4. Sending limits and conduct

We limit how much is sent from your account, currently fifteen messages a week and sixty in any thirty day period, and we may change these limits. These limits exist to protect your account. You agree not to attempt to circumvent them.

You agree not to use AviSeek to send unsolicited commercial messages, to promote a product or service, to harass anyone, or to send anything false about your qualifications. We may suspend sending immediately if we believe the service is being used this way.

5. Employers and opt-outs

Every message includes a working link that lets the recipient opt out. An opt-out is honored across the whole service, immediately, for every user. You may not attempt to contact an employer through AviSeek after they have opted out.

Employer contact details in AviSeek come from public sources including government registries and the employers' own published information. We show you matching employers but we never give you their contact details directly.

6. Subscriptions and payment

AviSeek is billed monthly at $19 or quarterly at $39, in advance, through Stripe. Your subscription renews automatically until you cancel. You can cancel at any time from your account, and cancellation takes effect at the end of the period you have already paid for.

Prices may change. If they do we will tell you before the change applies to your subscription.

7. The first-month commitment

If your search area contains enough reachable employers, we will attempt to send your application to at least forty distinct employers during your first paid month. We check that the inventory exists before we let you subscribe, and if it does not, we will not sell you a subscription.

What counts

An employer counts when we successfully hand your message to your email provider for delivery. Whether the employer opens it, replies, or is currently hiring is outside our control and is not part of this commitment.

What has to be true

This applies only where, for the whole of that month, you have:

completed your profile, including a resume and your short description;
kept a working email connection in place; and
left sending enabled.

If you pause sending, disconnect your email, change your search area, your email provider blocks or rate-limits us, or employers in your area opt out, we cannot deliver the full number and this commitment does not apply for that month.

If we fall short

Tell us within 30 days of the end of that month and we will refund that month’s subscription fee in full. That refund is your sole and exclusive remedy for not reaching the number, and our liability for it is limited to the amount you paid for that month.

Changes

We may change the number or the terms of this commitment for future billing periods. Any change will be published here before it applies to you, and it will never reduce a commitment for a month you have already paid for.

8. What we do not promise

We do not promise that any employer will reply, interview you, or hire you. We do not promise that any particular employer is currently hiring. We do not promise that every address we hold is current, though we check them and remove those that fail.

Hiring outcomes depend on your qualifications, your timing, and the employer. Nothing in this service is a guarantee of employment.

9. Your content

You keep ownership of your resume, your profile and everything you write. You grant us permission to use them for the purpose of sending your applications and operating the service. When you delete your account we delete them, subject to the retention described in our Privacy Policy.

10. Availability

We aim to keep AviSeek running but we do not promise uninterrupted service. We may change or discontinue features. If we discontinue the service entirely we will give you notice and refund any period you have paid for and not used.

11. Suspension and termination

You may stop using AviSeek at any time. We may suspend or close your account if you breach these terms, if your use puts the service or other users at risk, or if we are required to. Where we close an account without cause we will refund the unused portion of your subscription.

12. Liability

To the extent the law allows, AviSeek is provided as is, and our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost job opportunities or lost income.

Nothing here limits liability that cannot be limited by law.

13. Changes to these terms

We may update these terms. If a change materially affects you we will tell you by email before it takes effect. Continuing to use AviSeek after that means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of Texas, United States, and any dispute will be heard in the courts of that state.
